Terms and Conditions

These Terms & Conditions ("Terms") govern your access to and use of the website (the "Site"), as well as any vacation rental services provided by MobayStayz ("we," "us," or "our") in Montego Bay, Jamaica. By using the Site or our services, including booking accommodations, you agree to these Terms. If you do not agree, please do not use the Site or our services.

1. Description of Services

We provide short-term vacation rental accommodations through MobayStayz in Montego Bay, Jamaica. Our accommodations include a variety of vacation rental units and hotel-style rooms. Depending on the property selected, accommodations may include:

Fully furnished vacation rental units or hotel-style rooms.
Some units include kitchens, bedrooms, and living spaces, while others consist of a private bedroom and bathroom only.
Options for daily, weekly, or monthly stays.
Amenities may include Wi-Fi, parking, and access to designated common areas, depending on the property.
Online booking through the Site, subject to availability.

2. User Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to book accommodations with us.

By using the Site or booking accommodations, you represent and warrant that you meet these requirements.

3. Booking and Reservations

Booking Process: Reservations may be made through our website or by direct contact. A valid payment method is required to secure a booking.

Payments: Rental fees are due in advance. Prices are quoted in either United States Dollars (USD) or Jamaican Dollars (JMD), depending on the booking, and include applicable taxes unless otherwise stated.

Cancellations: Guests must cancel within the applicable notice period stated at the time of booking to avoid cancellation charges. Refunds are subject to the cancellation policy associated with the reservation and our discretion where applicable.

Check-in / Check-out: Standard check-in begins at 3:00 PM, and check-out is by 11:00 AM. Early check-in or late check-out may be available upon request and may be subject to additional fees.

4. Guest Responsibilities

Guests agree to:

Comply with all house rules, occupancy limits, applicable laws of Jamaica, and any strata bylaws governing the property.
Treat the property with respect and report any damages immediately.
Avoid illegal activities, excessive noise, or behavior that disrupts neighbors or other guests.
Accept responsibility for any damages beyond normal wear and tear caused by themselves or their guests.
Not sublet or assign the booking without our prior written consent.

5. Prohibited Conduct

You agree not to:

Use the property for parties, events, or commercial purposes without prior authorization.
Bring hazardous materials, illegal substances, or items prohibited under Jamaican law onto the property.
Access restricted or staff-only areas of the property.
Provide false or misleading information during the booking process.

6. Intellectual Property

All content on the Site, including but not limited to text, photographs, graphics, logos, branding, and website design, is owned by MobayStayz or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, publish, or otherwise use any content without our prior written consent.

7. Disclaimers and Limitation of Liability

Our services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

To the fullest extent permitted by law:

We are not liable for accidents, injuries, illness, theft, loss, or damage to personal belongings occurring during your stay.
We are not responsible for interruptions or disruptions caused by circumstances beyond our reasonable control, including severe weather, natural disasters, power outages, internet interruptions, governmental actions, or other force majeure events.
Our maximum liability arising from your booking or use of the Site shall not exceed the total amount paid by you for the applicable reservation.

8. Indemnification

You agree to indemnify, defend, and hold harmless MobayStayz, its owners, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

Your use of the Site;
Your stay at any MobayStayz property;
Your violation of these Terms;
Any damage caused by you or members of your party.

9. Termination of Stay

We reserve the right to terminate your reservation and require you to vacate the property immediately if you violate these Terms, the applicable house rules, or any applicable laws or strata bylaws.

In such circumstances, no refund shall be provided.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Jamaica. Any disputes arising out of or relating to these Terms or your use of our services shall be resolved exclusively in the courts of Jamaica.

11. Changes to Terms

We may revise or update these Terms at any time without prior notice. Any changes become effective upon posting on the Site. Your continued use of the Site or our services following the posting of revised Terms constitutes your acceptance of those changes.
